Mediation Services

 

Mediation is a form of alternative dispute resolution that allows the parties to guide and formulate resolutions to their disputes outside of the courtroom. Parties may agree to enter into mediation as an alternative to litigation or they may be ordered by the Court, as part of the litigation process, to participate in mediation before the Court will hear their dispute. Mediation is a confidential process that provides parties with an opportunity to work with a neutral third party to discuss their dispute in a constructive manner so that they may tailor agreements that meet the specific needs of their family and avoid the emotional and financial toll of litigation.

Mediation Services Rate-$300 per hour*

(ODR rates available for qualifying cases)

*Hourly rates are to be shared equally between parties unless otherwise agreed or ordered.  if there are more than two parties involved, additional parties are billed at $150 per hour per party. There is a 2 hour minimum and sessions are scheduled as half-day or full day. An advanced fee of 2 hours of time for half-day sessions and 4 hours of time for full day sessions is required 10 days prior to the scheduled mediation session.  If this payment is not received 10 days prior to your session, your session will be cancelled and you will need to reschedule for a date that allows you ample time to make the required advance payment.   Sara typically holds 4 hours of time on her calendar for half-day sessions and eight hours of time on her calendar for full day sessions.  Payment for additional time beyond the required advanced fee will be due at the completion of the session.  All mediation sessions will be held at The Law office of Sara A. Evanczyk, LLC in Frisco unless otherwise agreed or ordered.

 

Parenting Coordinating & Decision-Making Services

*Sara is not currently taking new PC/DM cases*

 

Parenting Coordinators (PCs) may be appointed in cases through the parties’ agreement or court order to assist parties in resolving disputes concerning parental responsibilities, including decision-making and parenting time. Specifically, PCs work with families to help identify the sources and causes of conflict, to develop parenting strategies to minimize the conflict, and to develop guidelines for communication. Decision Makers (DMs) may be appointed through parties’ agreement to make binding decisions to resolve disputes regarding the implementation or clarification of existing orders concerning the parties’ minor or dependent children, including disputes regarding parenting time, specific parental decisions, and child support.
